ACCOUNTABILITY OF THE PRESIDENT UNDER THE COMMAND RESPONSIBILITY DOCTRINE

Abstract


While there is some agreement in this jurisdiction that the doctrine of command responsibility1 is considered part of the customary international Law that should be considered part of the law of the land,2 the question posed in this paper is: how high up the chain of command should the doctrine be applied? Does it go all the way up to the President, who is the commander-in-chief of the armed forces?3 It is the thesis of this piece that the question should be answered in the affirmative.
